I. BASIC PROVISION
I.I. These terms and conditions (hereinafter referred to as the "Terms") set out the detailed terms and conditions of the Yoga&Dance Spring Festival Ostrava, under which the company MAHA SHAKTI PRODUCTION s.r.o., ID: 04678222, with registered office at Jandová 2879/5, 700 30 Ostrava, phone: +420 734 335 216, web . website: http://jogafestival.cz, (hereinafter referred to as the "Festival"), provides the other contractual party (hereinafter referred to as the "Customer") a ticket to the Yoga&Dance Spring Festival Ostrava event (hereinafter referred to as the "Service") and regulates mutual rights and obligations, on the basis of a contract that is concluded in accordance with these Terms and Conditions and which is governed by these Terms (hereinafter referred to as the "Contract"). The contract is considered concluded by the completed purchase of the ticket (hereinafter referred to as "Registration").​​

II. REGISTRATION AND CONTRACT CONCLUSION
II.I. By purchasing tickets to the Festival, the Customer registers and confirms that he has read these Terms and Conditions, understands their content, has no objections to them and agrees to them.

II.II. By purchasing tickets, the Contract is concluded in written form electronically between the Festival and the Customer.

II.III. By entering the festival, the Customer confirms that he has read these Terms and Conditions, understands their content, has no objections to them and expresses his agreement with them.

III. PRICE FOR SERVICES AND PAYMENT
III.I. Prices are listed for individual types of tickets HERE.

III.II. The purchase of a ticket and thus the conclusion of the Contract can be done by A. bank transfer to the indicated bank account of MAHA SHAKTI PRODUCTION s.r.o. number 2000920092/2010 maintained at Fio Banka a.s., or B. online payment gateway of the company Stripe.

III.III. After the successful payment of the ticket and thus the conclusion of the Agreement, the Customer will receive a tax receipt for the payment made and a ticket in the form of a PDF with the name of the Customer, the name of the Festival, the date and place of its event, as well as an indication of the type of ticket.

IV. RIGHTS AND OBLIGATIONS OF THE CONTRACTING PARTIES
IV.I. The Festival's obligations related to the Service are governed exclusively by these Terms.

IV.II. The venue of the Festival is located at the address given HERE. These spaces are open according to the currently valid Festival program, which is located on the website HERE.

IV.III. The customer has the right to participate in the program according to the type of ticket purchased.

IV.IV. The customer has the opportunity to attend individual lessons from the Festival program for which he owns a ticket. without further reservation.

IV.V. The customer is obliged to provide his personal data correctly and truthfully.

 

V. DURATION AND TERMINATION OF THE AGREEMENT
V.I. The contractual relationship between the Customer and the Festival in accordance with these Conditions lasts for the period of ticket purchase until the end of the Festival program.

V. II. The customer can cancel his Festival Registration at any time without giving a reason and thus terminate the Agreement. The amount of money for the purchased ticket is thus forfeited to the Festival.

V. III. In the event of cancellation of the Agreement by the Festival due to the non-performance of the Festival event, the amount of money will be returned to the Customer's bank account, unless otherwise agreed by the contracting parties.

VI. PROTECTION OF PERSONAL DATA
VI.I. The Festival processes personal data for the purpose of concluding and fulfilling the rights and obligations arising from the Contract with the Customer. The processed personal data is provided with the highest standard of protection in accordance with the legal regulations in the field of personal data protection and the statement on the protection of personal data for customers listed on the website of the service provider.

VI.II. The Festival undertakes to observe the confidentiality of the Customer's personal data and to provide them with sufficient protection so that there can be no unauthorized or accidental access to personal data, their change, destruction or loss, unauthorized transmission, their unauthorized processing as well as other misuse of personal data.

VI.III. The Festival processes personal data in the exact form in which it is obtained from the Customer, in accordance with the specified purpose for which it is processed and to the extent necessary for the fulfillment of such purpose, and keeps it only for the time necessary for the purpose of its processing.

VI.IV. The customer is entitled, in addition to his rights arising from legal regulations, to request the service provider to provide information on the scope of personal data processing in relation to the performance of the Agreement.

VII. PHOTO AND VIDEO MEDIA
VII.I. By concluding the Agreement, the Customer agrees that photographers and videographers will be present at the Festival premises throughout the duration of the Festival, who will record the Festival event in the form of digital photos and video recordings.

VII.II. The Customer acknowledges and agrees that the Customer himself may be photographed or filmed by a photographer or videographer.

VII.III. The festival undertakes that such photos and/or video recordings will be kept and not sold to any third party.

VII.IV. The Festival undertakes that such photographs and/or video recordings will be used in the future exclusively for marketing purposes to promote the Festival on the Festival's website and/or social networks, or printed materials.

VII.V. The customer has the right to express his disagreement with the use of the photo or video recording,

VII.VI. Such disagreement can only be expressed by the Customer in writing (to MAHA SHAKTI PRODUCTION s.r.o.) or by email (info@jogafestival.cz) to the Festival with the submission of the said photo or video recording.

VII. FINAL PROVISIONS
VII.I. All arrangements between the Festival and the Customer are governed by the law of the Czech Republic. If the relationship established by the Agreement contains an international element, then the parties agree that the relationship is governed by the law of the Czech Republic. This does not affect consumer rights arising from generally binding legal regulations.

VII.II. The festival is entitled to unilaterally change or supplement these Terms and Conditions or the price list at any time. Changed or supplemented Terms and Conditions become effective on the day they are published on the Festival's website, the Festival's social networks and via e-mail to the Customer.

VII.III. Customers' suggestions and complaints about the quality of the Festival's services or facilities can be sent to the email: info@jogafestival.cz

VII.IV. These Terms and Conditions are valid and effective from August 1, 2023
